Michigan Senate OKs teacher tenure changes

LANSING -- School districts could more easily fire bad teachers under a package of bills approved Thursday in the Senate and now headed to Gov. Rick Snyder's desk.

The four bills would:

• Extend from four years to five the time it takes a new teacher to earn tenure protection.

• Bar districts from using seniority as a primary factor when laying off teachers.

• Require parents to be notified in writing if their child is taught by a teacher rated "ineffective."

• Add seven items to the list of things unions can't bargain for -- including placement of teachers, personnel issues related to layoffs and decisions regarding discharge or discipline of an employee.

"This is a very momentous day in the progress of education in the state of Michigan," said Sen. Patrick Colbeck, R-Canton. "This is a victory for the children of Michigan."

Teacher unions vigorously opposed the legislation.

"It's sad," said David Hecker, president of the American Federation of Teachers-Michigan. "The Legislature has the power to take action to improve education for all of our children and rather than do that ... they're coming after teachers, the men and women who educate our children."

But Sen. Phil Pavlov, R-St. Clair Township, who steered the bills through the Senate, said: "Good-quality teachers in our state should be pleased with this legislation. They've got nothing to worry about."

The action came on the Legislature's final day before breaking for a summer recess and ended six months of dramatic change in how Lansing operates. Republican majorities in the state House and Senate and GOP Gov. Rick Snyder led overhauls of the state's business and personal income tax systems and won approval of a new budget at the earliest date since Ronald Reagan was president.

The House and Senate failed to resolve differences on bills that would put limits on what cities and school districts could spend on health care for their employees.

A compromise will have to wait at least until July 13, when the Senate may return for a day.

Wrong approach, teachers say

The tenure legislation came on the heels of widespread criticism that it takes too long -- an average of nine months, an AFT-Michigan report found -- to try to fire a bad teacher.

And, the costs are so high -- some districts reporting as much as $100,000-$200,000 on the cases -- that many school administrators don't bother trying to fire ineffective teachers.
