Finding Property Tax Relief Through The Grievance Process
East Hampton homeowners are feeling the pinch of an economy that provides fewer jobs, higher taxes and little relief from banks unable or unwilling to refinance. Many are looking for any way to save a few dollars, and property tax relief is one avenue.
Those who filed a property tax grievance this year by the deadline of May 17 will be hearing soon about whether the East Hampton Town representatives agreed with their number. August 1 is the deadline to appeal for those who filed a grievance on time and are dissatisfied with the decision.
It’s not too early to prepare for next year’s grievance day, as petitioning the town to lower the tax basis requires an appraisal that is up to one year old. Homeowners confident their house will come in at substantially lower than the current tax basis may well consider having an appraisal done now. Those who have tried recently to refinance usually have an appraisal in hand.
Applying for tax relief is often successful. One example: a house assessed by the town at $1,720,000 in 2009, appraised by a bank for $1,400,000, and has today, according to realtors, a market value of $1,300,000.
Some prefer to hire lawyers who do not charge up front, but rather take a percentage of what they save as a fee. The bottom line is that if a house cannot be sold for the number listed on the tax bill under “full value,” the homeowner may well be able to save tax dollars by completing the process. The grievance form is also on the web.
East Hampton Town Assessor Jill Massa said she helps those who want to make an application.
“We do everything we can short of filling it out for the taxpayer,” she said, adding that forms can also be obtained directly from that office at Town Hall. “We have it on the counter.”
Once completed, the recent appraisal must be attached and mailed in or dropped off.
Grievance applications are up 400 percent in East Hampton Town, from 554 in 2005 to 2,400 in 2010. Of the most recent number, 13 percent, or 310, were submitted by self-filers.
It takes 45 days to receive word as to whether the town has approved a petition for relief. If a petition is rejected, it is the homeowner’s right to appeal to the office of the Suffolk County Clerk.
